1. Introduction
NETMOS is a digital logistics platform designed to facilitate transport, logistics, fleet management and authorised government services. The mobile apps under the NETMOS system are Rush, Pragati and Pragati Driver.
By accessing or using NETMOS, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions. If you do not agree with these Terms and Conditions, you should not access or use the platform.
2. Eligibility
The platform may only be used by authorised individuals, organisations, transporters, government officials and other authorised stakeholders.
Users must provide accurate information when using the platform and must comply with all applicable laws, regulations, rules and official requirements governing their use of NETMOS.
3. Accounts
Users are responsible for safeguarding their account credentials and maintaining the confidentiality of information used to access their account.
Users are responsible for activity carried out through their account and should promptly notify the administrators of any suspected unauthorised access, loss of credentials or other security concerns.
4. Acceptable Use
Users shall use NETMOS only for lawful and authorised purposes. Users shall not misuse the platform or attempt to compromise its availability, security or integrity.
Users shall not attempt unauthorised access, upload malicious software, impersonate another person or organisation, interfere with government integrations, access information without authorisation, or otherwise violate applicable laws and regulations.
5. Government Integrations
NETMOS may integrate with government platforms, including ULIP and other authorised services, for providing relevant logistics, transport and government-related services.
Availability and functionality of such integrations may depend upon the respective third-party or government services. NETMOS does not guarantee uninterrupted availability of services provided through such external integrations.
Users shall access and use only the information and services for which they are authorised.
6. Privacy and Data
Information is processed for the purpose of providing authorised services through NETMOS and for operating, maintaining and securing the platform.
Users consent to the collection, storage and processing of information that is necessary for operation of the platform in accordance with applicable Indian laws.
Users should ensure that information submitted through the platform is accurate and that they are authorised to provide such information.
7. Intellectual Property
The software, technology and platform components developed by Floww APIs Private Limited remain protected by applicable intellectual property laws.
Government data, records and official content remain the property of NERCORMS or the relevant government authority, as applicable.
Nothing in these Terms and Conditions transfers ownership of intellectual property or government data to a user.
8. Suspension and Termination
Accounts may be suspended or terminated where necessary due to fraud, misuse, policy violations, security risks, unauthorised activity, violation of applicable laws or legal requirements.
Access may also be restricted where required to protect the platform, its users, government integrations or other authorised services.
9. Disclaimer
NETMOS services are provided on an "as available" basis. NERCORMS and Floww APIs Private Limited do not warrant uninterrupted availability of the platform or services, particularly where third-party or government services and integrations are involved.
Service availability may be affected by maintenance, technical issues, network conditions, third-party dependencies or changes in government services.
10. Limitation of Liability
To the fullest extent permitted by applicable law, neither NERCORMS nor Floww APIs Private Limited shall be liable for indirect, incidental or consequential damages arising from or relating to the use of the Services.
11. User Account and Data Deletion Policy
Users who wish to delete their NETMOS account and associated user data may request account deletion by sending an email to info@netmos.in.
The deletion request should be sent from the user's registered email address and should clearly mention that the user is requesting deletion of their NETMOS account and associated data.
After receiving the request, NETMOS will process the account deletion request and delete the applicable account and user data within 4 working days.
Once the deletion process has been completed, the user will be notified by email at the registered email address.
Where retention of specific information is required by applicable law, regulation, legal proceedings, government requirements or other lawful obligations, such information may be retained to the extent required by law.
12. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of India.
Courts at Shillong, Meghalaya shall have jurisdiction in relation to matters arising from these Terms and Conditions, unless otherwise required by applicable law.
